Not having a complete public inspection file for KESQ(AM) in Indio, Calif. tripped up Gulf-California Broadcasting Co.
The FCC proposed a $15,000 fine for the licensee and directed the broadcaster to submit a sworn statement within 30 days testifying its public file has been brought up-to-date.
During an inspection in February, FCC agents said they found KESQ was missing 25 issues/program lists, meaning all the lists since the stations last license renewal was granted in 2005. Station management told the Enforcement Bureau’s San Diego office that the facility had only recently discontinued a Time Brokerage Agreement but that the operator couldn’t locate the missing files.
The commission said it increased the penalty an additional $5,000 because of the length of time the files have been missing.
The licensee has 30 days to appeal or pay.
