What Is DigiMedia’s Next Move?

Response deadline to USTPO is Jan. 19, 2013

With the U.S. Patent and Trademark Office this week rejecting claims in the second ex parte reexamination of patents held by DigiMedia Holding Group LLC, as previously reported by Radio World, observers are speculating what the company’s next move might be. 

DigiMedia, which holds two patents describing hard-disk automation systems like those used by radio stations, has until Jan. 19,2013, to respond to USPTO examiner Alexander Kosowski’s claim rejections, according to the USPTO documents.

“That deadline is commonly extended by the Patent Office for 30 more days if the patent owner explains the need for more time. The deadline is rarely extended for a greater period of time,” said Scott Daniels, an intellectual property attorney with Westerman, Hattori, Daniels & Adrian, LLP. 

Meanwhile, the long-running radio automation suit against a number of large broadcast groups — including CBS Radio, Greater Media, Beasley Broadcasting, Entercom and Cox — remains on hold. Together the defendants own some 729 radio stations, according to court documents. 

A federal judge issued a stay in the patent infringement litigation until the patent claims are decided.
