The FCC denied the appeal of Jack Gerritsen, fined $10,000 for operating a ham station without authorization. The California resident argued the agency was trying to deprive him of his First Amendment rights to criticize “the president and his obscene war.”
The commission said in its decision that the right to free speech does not include the right to use radio facilities without a license.
