$22,000 Fine Against Miami Pirate Upheld

FCC says Judith Smith operated unlicensed station out of her home

The FCC has upheld a $22,000 fine against Judith Smith for operating a pirate station and not allowing FCC agents to inspect the station.

The commission previously issued a Notice of Apparent Liability to Smith, whose last name used to be McFarlane, for operating a pirate station on 95.9 MHz out of her Miami home.

The agency now says Smith has not responded to the May 2011 notice and that’s why it’s taken the penalty to the next level, which is a Forfeiture Order.

If Smith doesn’t pay within 30 days, the commission may turn the case over to the Justice Department for collection.
