CBS Takes 2004 Indecency Case to New Level

CBS continues to maintain the Janet Jackson bare breast incident from the 2004 Super Bowl half-time show broadcast was unscripted and therefore the CBS O&As should not be fined a total of $500,000 for indecency.
In a lawsuit filed Monday, CBS told a federal court the FCC’s “zero tolerance” policy has the potential to cut off free speech.
In response, an FCC spokesman said, “CBS believes there should be no limits on what can be shown on television even during family viewing events like the Super Bowl; we continue to believe they are wrong.”
