Court Fight Develops Over Online Royalties

NAB, Bonneville and NRB argue that the CRB failed to follow statutory standards for rate-setting and adopted rates based on flawed methodology.

NAB is opposing the ruling that increased online royalties.

It filed a brief this week with the D.C. Circuit Court challenging the Copyright Royalty Board decision.

NAB filed the brief along with Bonneville International Corp. and the National Religious Broadcasters Music License Committee.

NAB says the ruling drastically increased the amount paid by radio stations and Webcasters for recordings streamed online. The ruling instituted a per-performance, per-listener royalty instead of an annual flat fee.
