HD Radio Patent Suit Delayed Again

Judge agrees to give both sides more time “to discuss possible settlement”

The judge overseeing the patent infringement case against 14 radio ownership groups that employ HD Radio technology has agreed for the second time this year to extend the deadline for broadcaster replies to the lawsuit.

U.S. District Court Judge Gregory Sleet has pushed the date to June 18 in order to honor a request for more time from the plaintiffs and defendants to give them “additional time to discuss a possible settlement,” according to new court documents co-signed by both sides.

The judge’s actions last week extended the deadline for broadcaster replies from April 25. Originally responses were due in late February.

Wyncomm LLC sued the broadcasters in November 2013 claiming that the voice and data transmission technology broadcasters use for their HD Radio broadcasts violates the patents it owns. Named as defendants in the federal lawsuit were Beasley Broadcast Group, CBS Radio, Clear Channel parent CC Media Holdings, Cox Media Group, Cumulus Media, Entercom, Entravision, Greater Media, Hubbard Radio, Radio Disney, Radio One, Saga, Townsquare Media and Univision.

Wyncomm lists Delaware Radio Technologies as the exclusive licensee for its technology. DRT is also listed as a plaintiff in the suit. Late last year the entities filed a similar suit alleging Ford, Chrysler, General Motors, Toyota, BMW and 13 other car companies are infringing on the same patents.

Observers have told Radio World in previous reports that the case appears to be moving toward a settlement considering the latest developments. Several broadcast groups contacted previously by Radio World have declined to comment on the suit citing the pending litigation.
