The Broadcast Decency Enforcement Act of 2005 modified the Communications Act of 1934 to increase the maximum forfeiture penalties for obscene, indecent and profane broadcasts.

The new law raises the maximum forfeiture to $325,000 for each violation with the maximum for a continuing violation now $3 million.
