Tower Fence Fine Cancelled in Pa.

The FCC has cancelled a proposed $7,000 fine for the licensee of WOYK(AM) in York, Pa. for failing to maintain a fence around the middle tower of a three-tower array.
The case stems from March 2002 when a field agent noticed that part of the fence around the tower had fallen off the post. WOYK argued that the entire section of the fence didn’t fall off, only the top portion, and that this would have made it difficult for someone to access the tower.
The station said the fence was repaired within 24 hours of the agent’s visit and asked for the fine to be dismissed or reduced.
The FCC cancelled the fine after deciding there was not enough evidence to conclude that WOYK had failed to maintain an effective locked fence around the tower.
