A U.S. appeals court heard arguments today in a lawsuit NAB filed against the FCC over its rules governing a new class of low-power FM stations. In its brief, NAB said the commission acted arbitrarily and capriciously in creating the LPFM rules, while the FCC said it acted reasonably. The appeals court does not have to act within a set time frame on the issue.
