Napster Inc, the MP3-file sharing service at the heart of the recording industry’s efforts to stop free music downloads available on the Internet, argued Monday that CD sales have increased as Napster has grown more popular. The company filed in opposition to the Recording Industry of America’s lawsuit against Napster in the United States District Court in the northern district of California.
Napster also argued that file sharing via the Internet is legal and cited several examples, including the Supreme Court’s decision in the so-called Betamax case. According to Napster, the Betamax decision determined that even if a technology is used in copyright infringements, the manufacturer could not be held liable for the abuses – even if the manufacturer encouraged them.
