FCC Says Too Soon to Appeal IBOC Power Boost

Two requests to review order are dismissed because they came too early

The Federal Communications Commission has dismissed two requests to review and reconsider its decision to allow the FM IBOC power increase.

The commission said in its dismissal letters that the applications were filed too soon. Though the IBOC order was released Jan. 29, it has not yet been published in the Federal Register. That publication sets into motion a 30-day period to seek review.

In his petition, Jonathan Hardis opposed the power boost because he said Media Bureau consideration of the issue is “premature” while Alan Jurison said the formula used for who can raise their power is too restrictive. Both Hardis and Jurison may re-file in the future, the FCC stated in its decision.
