Rep. Billy Tauzin, R-La, chairman of the House Telecom Subcommittee, has asked the Department of Justice to investigate whether the FCC violated the law by lobbying against H.R. 3439, the bill that would limit the number of low-power FM stations the FCC could license. The bill’s author, Rep. Michael Oxley, R-Ohio, also wrote to the DOJ.
FCC Chairman Bill Kennard said his staffers sending faxed information to members of Congress opposing the bill did not violate the Anti-Lobbying Act.
Kennard stated government staffers may communicate directly with members of Congress and their staffs in support of Administration or department positions.
