Napoli, hired by the NAB, filed a statement with the FCC demonstrating that “the satellite radio market is in fact a distinct market for antitrust purposes, and that a merger of Sirius and XM would lead to monopoly conditions in the downstream consumer market, as well as monopsony conditions in the upstream programming market, that our antitrust laws are intended to protect.”

Napoli is an associate professor in the graduate school of business, and director of the Donald McGannon Communication Research Center at Fordham University in New York.
