The FCC found Emmis-owned WKQX(FM), Chicago apparently liable for $7,000 for airing what it says is indecent language. A listener sent the agency a tape containing a portion of “Mancow’s Morning Madhouse” with lyrics to a sing called “Smell My Finger” that the agency said contained graphic and explicit sexual references and aired between 8 a.m. and 8:10 a.m., outside of the broadcast indecency “safe harbor” of 10 p.m. to 6 a.m.
Emmis told the FCC it does not routinely archive tapes or transcripts and cannot verify the accuracy of the transcript. Emmis also said the material is not indecent.
The FCC disagreed and Emmis has 30 days to either pay the fine, or ask that it be cancelled or reduced.
