Telemarketing Suit Against Clear Channel Thrown Out

A federal judge last week threw out a lawsuit Thursday against Clear Channel, alleging one of its stations violated laws designed to curb unwanted telemarketing calls, the Associated Press reports. The story was carried in the LA Times, among other media. The station is WLTW(FM) in New York. The lawsuit by Mark Leyse sought class-action status. The judge said the FCC has found that such messages by broadcasters are exempt from those rules if the message is merely to invite a consumer to “listen or view a broadcast.”
