The FCC upheld an earlier $10,000 fine against Neal Davis for operating a pirate station on 96.1 MHz in Fort Lauderdale, Fla.
The proposed penalty progressed to a forfeiture order in November 2011 after the agency said Davis didn’t pay the fine nor answer the FCC notice.
Davis doesn’t deny that he ran the station, but claimed he has no job and can’t pay the penalty. He also claims to be homeless.
In its decision, the FCC said it couldn’t verify that, but did note its earlier correspondence was sent to his residence using First Class mail and Certified mail, return receipt requested and Davis is not disputing the documents were received.
The commission denied Davis’ appeal, saying he didn’t provide any documentation to back-up his financial status and ordered him to pay the $10,000 within 30 days.
