Noncoms Dodge Auction Bullet

A federal appeals court in Washington this week ruled that nomcoms are not exempt from participating in auctions when they want licenses in spectrum out of the reserved band. Noncoms are already exempt from spectrum auctions for the reserved band, but the FCC had said they had to pay for spectrum outside of that band. The court said noncoms are exempt from all spectrum auctions.
