NAB’s court appeal of the LPFM rulemaking has moved forward. The association has filed a brief with the U.S. Court of Appeals for the D.C. Circuit to prohibit the FCC from implementing LPFM frequency allocations.
The FCC “abdicated its critical role in preventing interference” by creating a new class of low-power FMs that would add hundreds of stations to the FM band, stated NAB in the filing.
NAB stated the FCC was “arbitrary and capricious” in its LPFM rulemaking for several reasons.
Oral arguments are scheduled for Nov. 28.
