Texas Station Hit With $25,000 Fine

The FCC issued a fine for $25,000 to Paulino Bernal Evangalism Inc., which runs KBRN(AM) in Boerne, Texas.
Its sins were failure to maintain a main studio in its community of license, have working EAS equipment or make available a public inspection file.
The licensee had challenged only the latter charge and asked to have the fine cancelled or reduced, citing an inability to pay.
He argued that the file was in plain sight at the studio/transmitter but that his limited grasp of English, combined with panic at the sight of the Enforcement Bureau’s field agent, caused him to forget where the file was.
The FCC rejected this argument and said the public file needs to be accessible at all times.
The agency said he also failed to prove his inability to pay the fine.
